JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 354, 504, 509 of the Indian Penal Code and Sections 67, 67(A), 67(B) of Information of Technology Act, 2008 and 12 of POCSO Act.

Allegation is that the petitioner took nude photo of the victim while she was taking bath and also made a joint photo illegally. The petitioner gave threat to marry and make physical relation otherwise he would flash the said photo publicly and demoralized her.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.5.2019 and has got no criminal antecedent. There is no allegation of tampering of

Patna High Court CR. MISC. No.38915 of 2019(2) dt.27-06-2019 2/2 witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to business rivalry. The petitioner runs a brick-kiln. There was a dispute regarding payment of bricks and for the said reason the present case has been instituted.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional and Sessions Judge-cum-Special Judge, Vaishali at Hajipur in connection with Vaishali Mahila P.S. case No.33 of 2018.
