JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The appellant seeks bail in connection with Jokhihat P.S. Case No. 20 of 2017 registered for offences punishable under sections 376/313of the Indian Penal Code and Section 3(i)(iv)(v) of the SC/ST Act.

Allegation against the appellant is that on pretext of marriage, he established physical relation with the informant due to that she conceived. When the informant asked about the marriage he suggested to abort her pregnancy and refused to marry with her.

Learned counsel for the appellant submitted that he is innocent and has falsely been implicated in this case due to previous enmity. The appellant has been in custody for about six months.

Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant bail to the appellant. However, learned 1st Additional Sessions Judge-cumSpecial Judge, SC/ST(POC) Act, Araria is directed to expedite the trial and conclude the same within a period of six months.
