JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State assisted by learned counsel for the husband of the deceased. Petitioners seek bail in a case registered under Sections 302/201/34 of the Indian Penal Code. On recovery of an unknown dead body, the present case was lodged by Chowkidar against unknown but in course of investigation, the husband of the deceased appeared and identified the dead body. The husband of the deceased also disclosed that petitioner no.1 had taken loan of Rs.1,00,000/- from the deceased and on the alleged date of occurrence, petitioner no.1 and others
Patna High Court Cr.Misc. No.40502 of 2016 (3) dt.22-11-2016 2/2 had called the deceased to take her money back and after that the deceased was found missing and subsequently, her dead body was recovered. Some witnesses claim to have seen the deceased quarreling with two male and female prior to her death. The investigation against the petitioners appears to have already been completed and except the allegation of last seen, there is nothing against them.
Accordingly, petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Balia P.S. Case No.326 of 2015.
