This Court, by taking into account that while allowing the prayer for anticipatory bail of the petitioner by order dated 2.7.2015 in Cr. Misc. No. 4529 of 2015, had recorded one condition of the petitioner for release on bail only if not accused in any case by overlooking the statement made in paragraph no.3 of the bail application clearly stating the petitioner being accused in two others cases, must be inclined to modify the order dated 2.7.2015 by deleting the condition no. (ii). In other words, grant of bail to the petitioner shall not be dependent on the criminal antecedent of the petitioner but, then, rest of the directions given in the aforesaid order dated 2.7.2015 in Cr. Misc. No. 4529 of 2015 shall remain intact.

The petitioner, therefore, must now surrender within a

Patna High Court Cr.Misc. No.37781 of 2015 (2) dt.03-09-2015 period of two months from today and make necessary deposits as per the earlier order dated 2.7.2015 and if the petitioner do so, the court below shall do the needful as directed earlier.
