The petitioner has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 408, 420, 468, 471 of the Indian Penal Code.

The prosecution case is that the petitioner being Panchayat Mukhiya and co-accused namely Abhinav Bharti, Panchayat Rozgar Sevak misappropriated Rs. 17.5 lakhs under the MANREGA scheme.

The earlier anticipatory bail of the petitioner was rejected by a Co-ordinate Bench of this Court (now retired) vide Cr. Misc. No. 23973 of 2014, but the Court directed for release of the petitioner on deposit of Rs.

17.5 lakhs.

Subsequently, modification application was filed vide Cr. Misc. No. 49592 of 2014,

Patna High Court Cr.Misc. No.38764 of 2015 (2) dt.29-09-2015 whereby the time was extended for deposit of Rs. 17.5 lakhs with further direction to deposit of Rs. 8,000/- before the District Legal Services Authority, Nalanda at Biharsharif hence, in the circumstances, now the present anticipatory bail application is not maintainable.

Accordingly, this anticipatory bail application stands dismissed.
