JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 26-10-2016 Heard Mr. Kanhaiya Prasad Singh, Senior Counsel for the petitioner and the APP for the State. Petitioner prays for grant of bail in Brahmpur (Chakki O.P.) P.S. Case No. 61 of 2006 registered under Sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Considering the allegation and other materials available, his prayer for bail was rejected under order dated 01.10.2013 passed in Cr. Misc. No. 17919 of 2013(Annexure-1). In the light of the liberty granted thereunder, the petitioner again filed his bail application which was disposed of vide order dated 13.08.2014 passed in Cr. Misc. No. 29540 of 2014 (Annexure-2). Again the petitioner moved this Court for bail which was considered and disposed of vide order dated 26.08.2015 passed in

Patna High Court Cr.Misc. No.46011 of 2016 (2) dt.26-10-2016 2/2 Cr. Misc. No. 13133 of 2015 (Annexure-3) wherein the Court recorded that the prosecution evidence has already been closed and the statement of the accused has been recorded under sections 313 Cr.P.C. Counsel for the petitioner states that thereafter the date for judgment was fixed as 14.06.2016 by the learned A.D.J.- V, Buxar but the informant, in order to delay disposal of the case, filed a transfer petition before the learned Sessions Judge which too was considered and rejected on 22.08.2016 (Annexure-5) Having heard the parties, the present application is disposed of directing the learned Court below in seisin of the matter to finally dispose of the trial being S.T. No. 333 of 2014 within four weeks from the date of production of a copy of the present order.
