2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amend) Act, 2022.

3. As per prosecution case, 9.960 litres foreign liquor has been recovered from shop of this petitioner and managed to escape from the place of recovery.

4. It is submitted by learned counsel appearing on behalf of the petitioner that no incriminating article has been recovered from the conscious possession of this petitioner and he has falsely been implicated in this case.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that this petitioner is named in the

Patna High Court CR. MISC. No.44575 of 2024(3) dt.06-08-2024 2/2 F.I.R. and illicit liquor has been recovered from shop of this petitioner. It is further submitted that petitioner has also got one criminal antecedent of similar nature.

6. Considering the aforesaid facts and circumstances, nature of accusation, recovery of illicit liquor from the shop of this petitioner and similar nature of antecedents, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
