The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147/149/353/504 of the Indian Penal Code.

The prosecution case is that when the police party went to make effect the attachment of the property in pursuance to the order passed by the learned CJM, the police officials were abused and restrained from executing the order. It is submitted by learned counsel for the petitioners that attachment was to be made of the property of Indradeo Yadav and the petitioners are only brothers of Indradeo Yadav whereas the specific accusation of making abuse against Bibha

Patna High Court Cr.Misc. No.35510 of 2015 (3) dt.04-09-2015 2/2 Devi, wife of Indradeo Yadav, who is Chairman of Gaya Municipal Corporation.

Considering the accusation against the mob, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Chandauti P.S. Case No.33 of 2015, pending before the learned Chief Judicial Magistrate, Gaya. With the above observation, this application is, accordingly, disposed off.
