The petitioner seeks bail in a case registered under Sections 295(A), 153(A) of the Indian Penal Code and Section 67 of Information Technology Act.

Allegation is that the petitioner used indecent and abusive language for Hindu Goddesses on facebook and most obscene pictures were also posted by him.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.08.2020 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.37792 of 2020(3) dt.15-03-2021 2/2 in the present case. The petitioner has been made accused due to mistake of fact. No indecent message was forwarded by him. The petitioner had no intention to cause harm to religious sentiments to other community.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj (Bathnaha) P.S. case No.365 of 2020.
