The petitioner apprehends his arrest in connection with Hulasganj P.S. Case no. 44 of 2018, registered under Sections 363 and 366/34 of the Indian Penal Code. The accusation is that on 18.03.2018, daughter of the informant, aged about 15 years, had gone to market but she did not return till evening. On search, informant came to know that his daughter has been enticed away by Amit Kumar. Thereafter, informant went to the house of Amit Kumar and asked whereabouts of his daughter then he was abused by the family members of the Amit Kumar.

Learned counsel for the petitioner submits that petitioner is the relative of Amit Kumar and in course of

No.40069 of 2019(2) dt.01-07-2019 2/2 investigation, daughter of the informant was recovered, whose statement has been recorded under Section 164 of Cr.P.C. in which she has detailed the name of Amit Kumar, this petitioner and Janardan Yadav having hand in her kidnapping. Further submission is that later on, the marriage of daughter of the informant has been performed with the Amit Kumar and taking into consideration the same, co-accused Janardhan Yadav has allowed privilege of pre-arrest bail on 28.06.2018 vide Criminal Miscellaneous No. 29592 of 2018.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jehanabad in connection with Hulasganj P.S. Case No. 44 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
