Heard learned counsel for the petitioner and learned APP for the State.
Petitioner is languishing in custody for the offences punishable under Sections 420/406/506 of the Indian Penal Code.
The F.I.R. is based on a complaint petition.
Allegation is that the complainant paid Rs.1,00,000/- in cash and Rs.90,000/- in bank account of some other person on persuasion of the petitioner to manage assignment in foreign country for the complainant.
Patna High Court Cr.Misc. No.49895 of 2016 (2) dt.13-12-2016 2/2 Submission is that the petitioner has got no criminal antecedent. There is no evidence of payment of cash to the petitioner. The money was deposited in the bank account of some other person.
Considering the nature of allegation and the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Siwan/Successor Court, in connection with Bhagwanpur P.S.
