Petitioner seeks bail in Udwant Nagar P.S. Case No.114 of 2019 instituted for the offence under Section(s) 399, 402 Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

It is alleged that police got information that some persons armed with fire arms are going in a car on Ara - Garhani Main road. The police during vehicle checking stopped one white coloured car, which was coming from Garhani. Persons sitting in the car started running away, but the police force arrested all the five persons sitting in the car. It is further alleged that one pistol and magazine loaded with five live cartridges were recovered from possession of the petitioner.

Patna High Court CR. MISC. No.37663 of 2019(2) dt.25-06-2019 2/2 Counsel for the petitioner submits that Petitioner is in custody since 22.03.2019 having clean antecedents. Petitioner has no concern with the alleged recovery of fire arms. Counsel for the petitioner further submits that coaccused, Pritam Yadav, has already been granted regular bail by co-ordinate Bench of this Court by order dated 27.05.2019 passed in Cr. Misc. No.34404 of 2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara, in connection with Udwant Nagar P.S. Case No.114 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
