The petitioner, who is in custody, seeks bail in connection with Bandhuwa Kuraba P.S. Case No. 17 of 2017 registered for the offences punishable under Sections 366(A) and 365/34 of the Indian Penal Code.

Informant is the father of victim girl, who has alleged that when his daughter Sabita Kumari aged about 13 years had gone to attend the call of nature along with Renu Kumari aged about 14 years, in the meantime, petitioner and other co-accused persons enticed both the girls and took them on motorcycle and fled away.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this

Patna High Court Cr.Misc. No.44647 of 2018(3) dt.27-09-2018 2/2 case. It has been further submitted that both the victim girls have been recovered and they made their statement under Section 164 Cr.P.C. in which they have not whispered any word against petitioner. Petitioner has no criminal antecedent and he is in custody since 09.04.2018 Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Bandhuwa Kuraba P.S. Case No. 17 of 2017.
