Petitioner seeks bail in Buxar Industrial P.S. Case No.38 of 2019 instituted for the offence under Section(s) 25(1b)a, 25(1-AA), 26, 29, 35 of the Arms Act. Counsel for the petitioner submits that there is no recovery of incriminating article from possession of the petitioner. Name of the petitioner has been taken by co-accused, Dharmesh Yadav, who was arrested by the police, along with one country made pistol and live cartridge.

Petitioner is in custody since 10.03.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court CR. MISC. No.39810 of 2019(3) dt.26-08-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Buxar Industrial P.S. Case No.38 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
