1. Learned counsel for the petitioner submits that the petitioner is ready to return the alleged defalcated amount of Rs. 6,77,897/- by way of a bank draft in the government account. Accordingly, he seeks permission to withdraw his second anticipatory bail application with liberty to surrender and seek regular bail. At the time of surrender, the petitioner undertake to deposit the aforesaid amount of Rs. 6,77,897 by way of a bank draft before the concerned court which may be handed over to the BDO, Govindpur, Nawada.

2. Considering the aforesaid submission, this bail application is dismissed as withdrawn with liberty to the petitioner to seek regular bail after paying the aforesaid amount of Rs. 6,77,897/- by way of bank draft in the government account.

It is made clear that if the petitioner surrenders along with the bank draft, the concerned court may consider the regular bail application of the petitioner on its own merit without being prejudiced by the fact that the anticipatory bail of the petitioner has been dismissed by this Court.
