Petitioner seeks bail in Barahat P.S.Case No.113 of 2017 registered for the offences under Sections 366A, 323, 504, 506/34/34 of the I.P.C.
Allegation against the petitioner is of kidnapping minor daughter of the informant.
Submission of the learned counsel for the petitioner is that though the petitioner has been named in the statement of the girl recorded under Section 164 Cr.P.C. but she has not whispered any word against the petitioner. He is in custody since 18.04.2018 having clean antecedent.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.45498 of 2018 (3) dt.11-09-2018 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur, in Barahat P.S. Case No.113 of 2017 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
