====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioners and the State. Petitioners are apprehending arrest in connection with a case registered for the offences under Section 307 and other allied Sections of the Penal Code. They are named in the First Information Report along with five others. It is submitted on their behalf that the injuries attributed to them is simple and not grievous.
Let petitioners, named above, surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and thereafter the injuries attributed to them be verified from the materials collected in the case diary from the injury report on
Patna High Court Cr.Misc. No.41371 of 2014 (2) dt.10-04-2015 2/2 record. In the event, injuries are found simple and not grievous petitioners be admitted to the privilege of bail to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 313 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C.. In case, injuries attributed to the petitioner are found grievous, the court below will pass appropriate order in accordance with law.
