The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/324/307/504/354B/379/447 of the Indian Penal Code.
It is alleged against petitioner no.1 Sanjay Thakur to have assaulted with 'farsa' on the head of Dilip Kumar Sah, petitioner no.2 Mahanand Thakur @ Mahanand Jha assaulted the informant with 'lathi' whereas petitioner no.3 Lalan Kumar Thakur assaulted on the head of Shyam Sundar with butt of the firearm.
It is submitted by learned counsel for the petitioners that injuries of all the three injured persons have been found to be
Patna High Court Cr.Misc. No.32007 of 2015 (2) dt.07-08-2015 2/2 lacerated caused by hard and blunt substance and none of the injured have received any injury caused by sharp cutting weapon. The petitioners' side lodged Jadiya P.S. Case No.34 of 2015 levelling accusation under sections 147, 148, 149, 341, 323, 354, 324, 326, 307 and 504 of the Indian Penal Code against the informant's side on 25.03.2015 and, thereafter, the present case was lodged on the same day. The petitioners' side also received injuries. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the nature of injury and the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Supaul in connection with Jadia P.S. Case No.35 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
