JUSTICE SUDHIR SINGH ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 04.08.2015 in a case registered for the offence under Sections 386,387 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that some accused persons came at the wine shop of the informant and demanded extortion money. Thereafter, they started assaulting the staff of the shop and fled away with Rs. 40,000/- and two mobile phones. Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 30897 of 2016 dated 08.09.2016 taking into account that there are nine criminal cases pending

Patna High Court Cr.Misc. No.25954 of 2017 (3) dt.20-09-2017 2/2 against the petitioner.

A report was called for from the court below regarding the stage of the case. It has been reported that summons have been issued upon the prosecution witnesses. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Barauni P.S. Case No. 235 of 2015, pending in the court of learned C.J.M. Begusarai.

The court below is directed to take all necessary steps to conclude the trial preferably within a period of nine months from the date of receipt/production of copy of this order. The District Magistrate, Begusarai and the Superintendent of Police, Begusarai, are also directed to ensure that the prosecution witnesses are produced on the next date fixed by the court below so that the trial could be concluded within the stipulated period.

Let a copy of this order be communicated to the District Magistrate, Begusarai and the Superintendent of Police, Begusarai.
