The petitioners apprehend their arrest in connection with Bikramganj P.S. Case No. 155 of 2019 registered under Sections 272 and 279 of the Indian Penal Code and Sections 30(a)/36 of the Bihar Excise Act, 2016.
The accusation is that in course of patrolling duty, two persons, on seeing the informant and other personal, succeeded to flee away from near about the Bamboo clamp of Manoj Singh. On search in the field, one litre country made liquor kept in one bottle was recovered. The local Choukidar disclosed the name of Surendra Singh (petitioner no.1) and
Patna High Court CR. MISC. No.39306 of 2019(2) dt.27-06-2019 2/2 Jallad Singh (petitioner no. 2), who succeeded to flee away. Learned counsel for the petitioners submits that petitioners have not been apprehended by the police on the spot but their names have surfaced on the basis of statement of local Choukidar due to dirty village politics and petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned ADJ-II-cumSpecial Judge, Excise Act, Rohtas at Sasaram, in connection with Bikramganj P.S. Case No. 155 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
