2. Heard learned counsel for the petitioners no. 1,2 and 3 and the State.

3. Petitioners apprehend arrest in a case registered for the offence punishable under sections 353/290/188 and other ancillary sections of the Indian Penal Code and sections 3⁄4 of the Damage to Public Property Act.

4. As per the prosecution case, petitioners blocked the road and when police tried to pacify the matter, they raised

Patna High Court CR. MISC. No.45068 of 2023(2) dt.09-08-2023 2/2 slogan against the Government and administration and obstructed police party to perform their official duty.

5. There is general and omnibus allegation against these petitioners and no specific overt act has been alleged against them. Petitioners claim clean antecedent.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners no. 1, 2 and 3 is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Muffasil Motihari Police Station Case No. 234 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
