The petitioner seeks regular bail in connection with Chandi P.S. Case No.145 of 2018 registered for offences punishable under Section 365 of the Indian Penal Code.

Allegation against the petitioner is kidnapping for ransom. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and petitioner is a teacher and on location of mobile phone, the police has recovered the boy from the outside of the house of the petitioner and it is also submitted by the petitioner that it is not the case of recovery of boy from the house of the petitioner. Petitioner has been languishing in custody since three months.

Patna High Court Cr.Misc. No.45186 of 2018 (3) dt.07-09-2018 2/2 Heard learned A.P.P. also who have opposed the prayer for bail and submitted that statement under Section 164 Cr.P.C. of victim disclosed that he has named the petitioner who got telephone to his father for ransom.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. Accordingly, the payer for bail is dismissed. (Vinod Kumar Sinha, J) Sanjeev/- U T
