====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 31-03-2022 Heard counsel for the petitioners and counsel for the informant. Learned APP for the State is absent. Kursakanta P.S. Case No.113 of 2021 was instituted on 16.06.2021 under Sections 341, 323, 324, 379, 307, 420, 504 of the Indian Penal Code.

As per the allegations, the informant who is related to the petitioners herein wanted her share of land which was repeatedly denied by the petitioners and their family members. On the date of occurrence when she along with her maternal uncle tried to take possession of the land it is alleged that she was assaulted.

The counsel for the petitioners admit that due to the land dispute, both the parties lodged FIR against each other and the case lodged by them was numbered as Kursakanta P.S. Case

Patna High Court CR. MISC. No.51471 of 2021(3) dt.31-03-2022 2/2 No.114 of 2021 lodged on 16.06.2021.

He further submits that considering the fact that the injuries have been opined to be simple in nature and they are in judicial custody since 18.06.2021, they may be granted the privilege of bail.

Taking into account the aforesaid facts as also that the petitioners are in jail since 18.06.2021 and the charge sheet has been submitted in the matter, let the petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of learned trial court in connection with Kursakanta P.S. Case No.113 of 2021.
