Petitioner seeks bail in Excise Case No.1013 of 2018 arising out of Makhdumpur (Tehta OP) P.S. Case No.379 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that two accused, namely, Sonu Kumar and Rahul Kumar @ Shubam Kumar were apprehended by the police. They disclosed the name of this petitioner and other accused persons. The police made search of Scorpio vehicle and motorcycle and recovered total 158.01 litres foreign liquor. Seizure list is part of the First Information Report. From the seizure list, it appears that there is no recovery from conscious possession of the petitioner.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II, Jehanabad, in connection with Excise Case No.1013 of 2018 arising out of Makhdumpur (Tehta OP) P.S. Case No.379 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
