The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.
The petitioner is the husband of the deceased. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide orders dated 5.11.2019 and 28.9.2020 (Annexure-1 series). Inspite of the petitioner being in custody till 11.8.2018 ie for more than 3 years, there is no progress in the trial in the learned trial Court.
Heard learned APP for the State.
A report was called for from the learned trial Court with respect to the stage of the trial. As per the report received
Patna High Court CR. MISC. No.51228 of 2021(3) dt.22-09-2021 2/3 contained in letter dated 13.9.2021 of the learned Addl. District and Sessions Judge XX, East Champaran, the case is fixed for framing of charge and charges are likely to be framed on 20.9.2021.
Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 3 years together with the contents of the report received from the learned trial Court with respect to the stage of trial, the petitioner is directed to be enlarged on bail in connection with Ghorasahan P.S. Case no. 323 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge XX, East Champaran.
It is directed that the petitioner shall cooperate in the trial in the learned trial Court. In case the learned trial Court is of the opinion that the trial is being delayed due to noncooperation on part of the petitioner, the learned trial Court will be at liberty to cancel the bail bond of the petitioner.
