Petitioner seeks bail in connection with POCSO Case No. 18 of 2019 arising out of Buxar (Town) P.S. Case No. 343 of 2019 registered for the offence punishable under sections 377 of the Indian Penal Code and sections 8, 4 of the POCSO Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case at the instance of his enemies. The present first information report has been lodged after about a month of the alleged occurrence without there being any explanation
Patna High Court CR. MISC. No.37771 of 2019(3) dt.13-09-2019 2/2 for the delay. The present case is counterblast of earlier case lodged by this petitioner vide Annexure-2. The matter has been compromised between the parties and a joint petition to that effect has been filed before the Court below vide Annexure-3. Petitioner has no criminal antecedent and is in custody since 21.04.2019.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Ist-cum-Special Judge, Buxar in connection with Buxar (T) P.S.
