JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-07-2023 Learned counsel for the petitioners is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners have preferred this application for grant of regular bail in connection with Baruraj P.S. Case No. 78 of 2021 dated 12.5.2021 registered for the offences punishable u/s 364/34 of the Indian Penal Code.

As per the prosecution case, the petitioner and the coaccused persons are alleged to have abducted the informant's

Learned counsel for the petitioners has submitted that the petitioners are innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioners. Nothing incriminating material has been recovered from the conscious possession of the petitioners. The victim in his statement recorded under Section 164 of the Cr.P.C. has not supported the case of his abduction. The co-accused person has already been granted bail by the Coordinate Bench of this Court vide order dated 23.5.2023 passed in Cr. Misc. No. 5066 of 2023. The petitioners have got clean antecedent as stated in para 3 of the bail petition. The petitioner No.1 is in custody since 11.10.2022 and the petitioner No. 2 is in custody since 6.3.2023. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bailbonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Baruraj P.S. Case No. 78 of 2021.
