JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 The petitioner is in custody since 26.02.2018 in connection with Galgaliya P.S. Case No. 10 of 2018, registered for offences punishable under Sections 420, 406, 467, 468, 409, 120(B)/34 of the Indian Penal Code.
Allegation as per F.I.R. is that the informant deposited Rs.82,000/- in three installments in the S.B.I., Galgaliya Branch, District Kishanganj and from before there is Rs. 51,000/- in her account and when she went for withdrawal, the Cashier has handed over Rs. 10,000/- and has given some receipts, but no entry has been made and only amount was given to her and when she complaint about the same to the petitioner who happens to be the Manager of the Bank, he has not taken any action. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and petitioner has removed the Cashier from his table, but in spite of that he has been made accused in this case and he is in custody since 26.02.2018.
Patna High Court Cr.Misc. No.45879 of 2018 (3) dt.12-09-2018 2/2 Heard learned A.P.P. as well as learned counsel for the State Bank of India.
Considering the aforementioned facts and circumstances, the period of custody and also that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000, (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Galgaliya P.S. Case No. 10 of 2018, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
