The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is a case of recovery of about 5 liters of country made liquor from the house of co-accused Krishna Dhangad. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner is suffering from paralysis since long due to which, he is unable to move without any help and for the same, the petitioner is under continuous treatment for his disease, which is supported by Annexure-2 series of the
Patna High Court CR. MISC. No.53711 of 2021(3) dt.09-05-2022 2/2 supplementary affidavit filed on behalf of the petitioner. Petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Bettiah Muffasil P.S. Case No. 363 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
