The petitioner seeks bail in Nokha P.S. Case No. 280/2018, instituted for offence under Section(s) 304B/34 of the Indian Penal Code read with Section 3⁄4 of the D.P. Act. It is alleged in the written report that daughter of informant was married with this petitioner on 05.05.2018. After marriage, she was tortured in her Sasural by this petitioner and other family members for demand of dowry. It is alleged that on 04.11.2018 informant received information that his daughter has been killed. Thereafter informant went to the Sasural of his daughter and found his daughter dead.
Learned Addl. P.P. has submitted that dead body of daughter of informant was found in the house of petitioner, as
Patna High Court CR. MISC. No.38408 of 2019(4) dt.16-08-2019 2/2 alleged in the written report.
Post-mortem report is available in case diary wherein doctor has opined cause of death asphyxia caused by throttling. Considering the fact that deceased died in unnatural circumstances in her Sasural within six months of her marriage, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected.
The trial court is directed to expedite the trial. (Sanjay Priya, J) rakhi/- U T
