2. The petitioner apprehends arrest in connection with Mirganj PS Case No. 56 of 2025 dated 03-02-2025, instituted under Sections 109, 118(2), 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita 2023 and Sections 27(3) of the Arms Act.

3. There is a specific allegation that co-accused Shahnawaj Alam shot Satyendra Singh, a co-villager of the informant, on the head, resulting in his death during the course of treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is submitted that the petitioner has been implicated in this case merely on the basis of the confessional statements of co-accused Sheikh Alimullah @ Thikedar and co-

It is further submitted that the petitioner and his wife, Shahida Begum, earn their livelihood by running a clinic in Mirganj, situated in front of the Mirganj Police Station. There exists a land dispute between the petitioner and Sheikh Alimullah @ Thikedar, who is the father of Shahnawaj Alam, and due to which, the petitioner has been falsely roped into the present case. It is also submitted that no criminal case is pending against the petitioner.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in Mirganj PS Case No. 56 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.

7. The application stands allowed.
