JUSTICE SANJAY PRIYA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 302/34 of the Indian Penal Code. It has been submitted that there is no specific over act against the petitioner. He is only alleged to be last seen with other co-accused.
The learned A.P.P. has opposed the prayer for bail. From the impugned order of the learned Sessions Judge, it appears that Bipin Singh and Radha Mohan Singh took away the husband of the informant (since deceased) from the house of the informant whereas the petitioner along with the other co-accused persons was lastly seen outside the house by the informant and witnesses.

No.54691 of 2016 (3) dt.28-01-2017 2/2 In such circumstances, this is a case of last seen, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwantnagar P.S.
