====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-06-2026 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 125(a), 115(2), 118(1), 109(1), 351(2), 352, 303(2), and 3(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 17.12.2025, at about 08:30 PM when informant along with his friend was returning home on motorcycle, all the F.I.R. named accused persons, including these petitioners and some unknown persons, reached

Patna High Court CR. MISC. No.40371 of 2026(2) dt.30-06-2026 2/3 there and petitioner nos. 1 and 2 assaulted informant with knife and petitioner no. 3 snatched gold chain from his neck.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Due to petty dispute, altercation took place between the parties. Injuries sustained by the injured are simple in nature. Case and counter case. Present case is counter last of Bettiah (Muffasil) P.S. Case No. 597 of 2025 which was filed by mother of petitioner no. 2 against the prosecution side. Rest of the allegations are ornamental only to make the case grave. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, injuries, case and counter case and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Learned C.J.M., Bettiah, West Champaran in connection with Bettiah (Muffasil) P. S. Case No. 598 of 2025, subject to
