JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Ms. Sushmita Mishra, the learned advocate for the petitioner and learned APP for the State. The petitioner is seeking regular bail in connection with Kochas Parsathua P.S. Case No. 146 of 2016 registered for the offences under Sections 341, 323, 354(A) and 354(B) IPC. The petitioner is the nephew of the informant and admittedly they are next door neighbour.
The allegations as disclosed in the First Information Report would show that the informant has alleged eve teasing and assault on her head and back.
The learned counsel for the petitioner would submit that the informant is aunt of the petitioner and they belong to the same family. The allegations against the petitioner are out and out
Patna High Court Cr.Misc. No.25320 of 2017 (3) dt.07-06-2017 false, concocted and baseless which would be evident from Annexure-2 which is the injury report. No injury has been found on head or back. The injuries reported are "pain in head". The petitioner is in custody since 05.2.2017 and the investigation is already over in the present case.
The learned APP opposed the prayer for bail.
In the facts and circumstances stated hereinabove, let the petitioner, namely, Shahim Alam be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas, Sasaram in connection with Kochas Parsathua P.S. Case No. 146 of 2016.
