Petitioner seeks bail in a case registered for the offence punishable under Section 376 of the Indian Penal Code. The report of the trial Judge dated 04.12.2018 would reveal that trial is likely to be concluded within six months. Considering the nature of allegation against the petitioner of commission of rape, I am not inclined to enlarge him on bail in connection with Gr. No. 711 of 2017 arising out of Amdabad P.S. Case No. 19 of 2017 pending in the court of learned 1st Additional Sessions Judge-cum-Special Judge, Katihar.

Hence, prayer for bail is refused.

The petitioner may renew his prayer for bail before the court below itself if the trial does not conclude within the aforesaid period. Kundan/- (Birendra Kumar, J) U T
