====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-04-2021 Heard Mr. Hare Krishna Prasad, learned counsel for the petitioners and Mr. Upendra Kumar, learned counsel for the informant. The State is represented by the learned APP.
The petitioners seek bail in anticipation of their arrest in connection with Singheshwar P.S. Case No. 276 of 2019 instituted for the offence under Sections 147, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code. Because of a she-goat having strayed in the field of
Patna High Court CR. MISC. No.37467 of 2020(2) dt.08-04-2021 2/2 the informant, an occurrence took place in which both sides have been injured. There is counter version of the occurrence as well. Two persons are said to have received injuries in the assault but the same cannot specifically be attributed to the petitioners. The petitioner no. 1 and another person from his side have also received injuries. Regard being had to the genesis of the occurrence, the nature of accusation and the fact that there is specific accusation against one Bablu Yadav, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs.
10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Singheshwar P.S. Case No. 276 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
