The petitioners seek bail in a case registered under Sections 419, 420, 485, 486, 487 and 34 of the Indian Penal Code.

Allegedly, sub standard cement was being constructed. In huge quantity, cement bags and other materials were recovered. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.37746 of 2019(2) dt.21-06-2019 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 02-04-2019. Charge sheet has already been submitted. No counterfeit cement is alleged to have been recovered. Petitioner Nos. 1 to 4 are labourers and working in the warehouse in question. The petitioner No. 5 is the driver. The petitioners have no concern with the alleged occurrence.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Bettiah, West Champaran in connection with Bairiya P.S.
