The petitioner seeks bail in a case instituted under Sections 341, 323, 354(B), 379, 307, 504, 506, 34 and 302 of the Indian Penal Code.
The prosecution story, in brief, is that when the son and daughter-in-law of the informant reached near the house of Naimuddin then the petitioner along with others forcibly took the daughter-in-law of the informant and abused her and snatched her golden chain and cash of Rs. 10,000/- and when the informant along with his wife and son came for preventing then all the accused persons with an intention to kill, assaulted with lathi and iron rod to the informant and his son, due to which, they sustained injury and thereafter villages came and took them at hospital for

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.04.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. The other coaccused persons have been granted bail vide Annexure-3 to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Kanti P.S. Case No. 122 of 2016.
