ANJANA MISHRA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Hathauri P.S. Case No.14 of 2015 for allegedly having committed the offences under Sections 147, 148, 149, 341, 325, 326, 307 and 448 of the Indian Penal Code. Case diary in the present case was earlier called for, which has since been received.

Learned counsel for the petitioners submits that so far as these petitioners are concerned, the allegation against them is only that they were present at the place of occurrence. The

Patna High Court Cr.Misc. No.32239 of 2015 (3) dt.03-11-2015 2/2 main allegation is against one Jugeshwar Sahani, who is said to have used sharp-cutting weapon for Bali on the informant's husband, son and grandson.

Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedents, let all the four petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Santosh Kumar Jha, learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Hathauri P.S. Case No.14 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
