JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and two others are named in the first information report but according to the prosecution case itself, petitioner was not known to the informant prior to the alleged occurrence and the culprits managed to flee away from the place of occurrence, leaving behind a motorcycle, which was seized by the police and, subsequently, it came to light that the aforesaid motorcycle belongs to one of the F.I.R named accused Pappu Kumar and, after that, villagers claimed that they had seen the aforesaid Pappu Kumar along with Mukesh Yadav and petitioner moving with the aforesaid motorcycle. Petitioner does not have any criminal antecedent and is languishing in jail custody since 17.08.2016.

Patna High Court Cr.Misc. No.46195 of 2016 (2) dt.21-10-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate,1st class, Madhepura in connection with Shankarpur P.S.Case No. 20 of 2016.
