The petitioner seeks bail in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 426 of 2016 registered for the offence punishable under Section 188/290 of the Indian Penal Code and 37(C) of the Bihar Excise Amendment Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 03.12.2016. He further submits that the allegation made in the First Information Report against the petitioner is false and fabricated. Nothing has been recovered from the conscious possession of the petitioner prohibited under Bihar Excise Amendment Act, 2016.

Considering the period of incarceration as also the facts

Patna High Court Cr.Misc. No.25257 of 2017 (2) dt.31-05-2017 2/2 and circumstances stated above, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Shivnarayanpur) P.S.
