The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 325, 342, 307, 224, 225, 332, 333, 353, 504, 506, 188, 341 and 323 of the Indian Penal Code. It is alleged that the accused persons were apprehended in a theft case and they have taken to the Police Station when co-accused Shatrughan Choudhary (non-petitioner) made protest and assaulted with rod as a result of which S.I. Khushbuddin received fracture injury when other accused

Patna High Court Cr.Misc. No.33902 of 2015 (2) dt.13-08-2015 2/2 persons assaulted to the police personnel.

It is submitted by learned counsel for the petitioners that the accusation is not specific against the petitioners and specific accusation is only against co-accused Shatrughan Choudhary. It is further submitted that there is no injury report of the other injured on the record. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation being omnibus and general against the petitioners and others, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 136 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
