2. The petitioner apprehend his arrest in connection with Bisfi( Patauna) P.S.Case No.355 of 2023 dated 11.0.2023 instituted for the offence punishable under Sections 379 of the Indian Penal Code.
3. As per the prosecution case, the informant's motorcycle was stolen by the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Allegation of theft against the petitioner is totally false. Nothing has been recovered from possession of the petitioner or from the house of the petitioner. Only on the basis of suspicion, petitioner has been implicated in the present case. As per the
Patna High Court CR. MISC. No.43130 of 2024(2) dt.10-07-2024 2/2 FIR, the occurrence took place on 02.09.2023 but the FIR has been lodged on 11.09.2023 after delay of nine days without giving any reasonable explanation. It is submitted that petitioner has clean antecedent.
5. Learned A.P.P for the State has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of the learned counsel for the parties, in the event of arrest/ surrender of the petitioner within a period of six weeks from today, in connection with Bisfi P.S.Case No. 355 of 2023 he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st Benipatti, Madhubani or appropriate Court Below, subject to condition as laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
