29-11-2021 At the outset, learned counsel for the petitioner seeks permission to make correction in paragraph 1 and prayer portion with regard to year of the police station case number. Permission is accorded. It may be done in course of the day.

Heard learned counsel for the parties.

Petitioners pray for grant of bail in Barauli P.S. Case No. 107 of 2018, registered for the offence under Sections 461, 379, 411, 414/34 of the Indian Penal Code.

As per the prosecution case, the F.I.R. named accused persons alongwith their associate committed theft of two motorcycles, cash of Rupees fifty thousand and one laptop from the show-room of informant.

No.51074 of 2021(2) dt.29-11-2021 2/2 It is submitted on behalf of petitioners that petitioners were not arrested on spot and they have been named in the F.I.R. as per confessional statement of apprehended co-accused namely Shiv Shankar Ram. No stolen motorcycle / looted article has been recovered from the conscious possession of petitioners and they are in custody since 24.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganj in connection with Barauli P.S. Case No. 107 of 2018.
