The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,436,353,329 and 504/34 of the Indian Penal Code.
It is alleged that on protest being made for uprooting the crop of the informant by accused persons, petitioner nos.1 and 2 Laxmi Panjiyar and Bharat Panjiyar outraged the modesty of the informant when protest was made, the petitioners assaulted with fists and
Patna High Court Cr.Misc. No.32144 of 2015 (2) dt.06-08-2015 2/3 slaps. When the son of the informant came to rescue, he was also assaulted and petitioner no. 3 Sitaram Panjiyar also took away golden chain. Petitioner no. 1 Laxmi Panjiyar set the house of the informant on fire. It is submitted by the learned counsel for the petitioners that for the occurrence of 27.3.2014 the complaint was filed on 1.4.2014 which came to be registered as police case on 1.5.2014. It is further submitted that petitioner Bharat Panjiyar earlier filed Complaint Case No. 1185 of 2013 against the informant's family. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. More over, there is nothing on record to suggest that actually the house of the informant was put on fire.
Considering the delayed lodging of the complaint and the case lodged by the petitioners side at earlier point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the
Patna High Court Cr.Misc. No.32144 of 2015 (2) dt.06-08-2015 3/3 like amount each to the satisfaction of learned CJM, Darbhanga in connection with Jale P.S. Case No.45 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
