Sanjay Paswan @ Bhura v. The State Of Bihar
Patna High Court Cr.Misc. No.36209 of 2016 (2) dt.24-08-2016
IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No.36209 of 2016 Arising Out of PS.Case No. -1 Year- 2014 Thana -DANIYAWA District- PATNA ====================================================== Sanjay Paswan @ Bhura .... .... Petitioner/s
Versus
The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Raj Nandan Prasad For the Opposite Party/s : Mr. Sri Rajeev Nayan ====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 24-08-2016 Heard learned counsel Mr. Raj Nandan Prasad for the petitioner.
It appears that the prayer for regular bail of this petitioner has already been rejected on 17.12.2015 by this Court in Criminal Miscellaneous No.55805 of 2015 considering the fact that the direct allegation against the petitioner is that he fired at the son of the informant as a result of which he died. It is not disputed by learned counsel for the petitioner that firearm injury, one entry and one exist was found by the doctor in the postmortem report. In such circumstances, I find no further grounds for allowing the application for regular bail to the petitioner. Thus, this criminal miscellaneous application is dismissed. The petitioner may renew his prayer after two years, if trial will not be concluded.
