The petitioner seeks bail in Naubatpur P.S. Case No.665 of 2015 registered under Sections 498A, 304B and 34 of the Indian Penal Code and under Sections 3 and 4 of the Dowry Prohibition Act.
The informant, father of the deceased, alleged that the marriage of his daughter was solemnised with Santosh Ram, the son of the petitioner in the month of April, 2015 but his daughter was done to death by her husband and other in-laws on 13.11.2015.
The learned counsel for the petitioner submits that the husband of the deceased has already been granted bail on the ground of being juvenile vide order dated 12.06.2017 passed in Criminal Revision No.401 of 2017. The mother-in-law of the
Patna High Court CR. MISC. No.33370 of 2020(3) dt.15-01-2021 2/2 deceased has also been granted bail vide order dated 31.01.2020. Petitioner being the father-in-law of the deceased is in custody since 28.08.2019. Petitioner was not even present at the time of occurrence. The deceased got burn injury while she was cooking food.
Taking into consideration the fact that petitioner is father-in-law of the deceased and the husband and the motherin-law of the deceased have already been enlarged on bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Danapur, Dist.-Patna in connection with Naubatpur P.S. Case No.665 of 2015.
