2. This is the 3rd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 04.04.2024 passed in Cr. Misc. No. 23056 of 2024. Thereafter, vide order dated 08.01.2025 passed in Cr. Misc. No. 85636 of 2024, the petitioner was granted bail with certain conditions.
3. The petitioner seeks regular bail in a case registered for the offence under Sections 25(1-b)a, 26(1) of the Arms Act.
4. The following order was passed on 08.01.2025 in Cr. Misc. No. 85636 of 2024:- Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner seeks bail in connection with Rupauli (Mohanpur O.P.) P.S. Case No. 272 of 2023 registered for the offence punishable under Sections
Patna High Court CR. MISC. No.38914 of 2025(2) dt.25-07-2025 2/3 25(1-b)a, 26(1) of the Arms Act.
3. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 04.04.2024 passed in Cr. Misc. No. 23056 of 2024.
4. The petitioner is in jail since 31.10.2023 for recovery of a country made rifle from the house of the petitioner.
5. It has been submitted by the learned counsel for the petitioner that there has been no progress in the trial and he claims to have clean antecedent.
6. Learned Additional Public Prosecutor appearing onbehalf of the State has vehemently opposed the prayer for bail.
7. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea/ concerned court in connection with Mohanpur O.P. P.S. Case No. 272 of 2023.
8. At the time of furnishing bail bonds, the trial court will verify the antecedent of the petitioner and will accept the bail bond if he has clean antecedent. If any case is found against him, his bail bonds shall not be accepted.
9. During the pendency of this case, the petitioner will mark his attendance in Mohanpur police station in the district of Purnea on every Sunday.
5. The learned counsel for the petitioner submits that the petitioner has been made accused in a case of 1992 i.e., Rupuali (Mohanpur) P.S. Case No. 86 of 1992, when he was ten years old.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

P.S. Case No. 272 of 2023 subject to condition that:- 7(i). The petitioner will mark his attendance at the Rupauli (Mohanpur) Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
