The petitioners seek bail in Bagaha P.S. Case No. 332 of 2016, registered for the offences punishable under Sections 379, 354B and other Sections of the Indian Penal Code. The informant named seven persons and alleged that they forcibly took articles from his shop and also assaulted Asha Devi and others.

Learned counsel for the petitioners submits that later on Section 395 of the Indian Penal Code was added. The petitioners are not named in the FIR. No specific allegation of assault is made against the petitioners. On account of some personal enmity the case has been lodged. Name of the petitioners figured in the case

Patna High Court Cr.Misc. No.48785 of 2016 (2) dt.09-01-2017 2/2 during course of investigation.

Considering the facts aforesaid and nature of allegations made against the petitioners and the fact that there is litigation between the parties from before and the petitioners are in jail since 06.09.2016, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha in Bagaha P.S. Case No. 332 of 2016.
