The petitioner in the present case is seeking regular bail in connection with Danapur RPF P.S. Case No. 2 of 2017 for offence registered under Section 3RP (UP) Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that a stolen T.V. was recovered from his possession. Learned counsel further submits that petitioner is innocent and in good faith he had purchased the T.V. for consideration. Further submission is that petitioner is in custody since 22.03.2017 and after this case, the petitioner has also been implicated in one other case by Danapur Rail Police, which the petitioner has recently come to know. He further submits that prior to the present case, the petitioner has no criminal history.
Patna High Court Cr.Misc. No.25793 of 2017 (2) dt.15-06-2017 2/2 Learned A.P.P. opposed the prayer for bail.
However, considering the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Railway Bhojpur at Ara in connection with Danapur R.P.F. P.S. Case No. 02 of 2017, subject to the condition under Section 437 (3) Cr.P.C.
